The Kaplan City Council will not take action tonight to fill a vacant seat because the Secretary of State's Office has not received notice of a councilman's resignation.
According to Mayor Kirk Champagne, Councilman at Large Herbert Gaspard submitted his resignation to the mayor's office and not to Secretary of State Tom Schedler.
By law, Champagne says, the seat becomes open after Schedler's office receives the resignation via certified mail and Schedler declares the seat vacant.
Champagne says the city's attorney has been in touch with Gaspard about sending his resignation to Schedler's office. Once the city is notified of Gaspard's official resignation, the council will hold a special meeting to fill the vacant seat.
Whoever is appointed as the interim councilman will hold the seat until July 1. That's when a new councilman elected to a four-year term will take office.
